The Charitable Foundation "Social Justice and Development of Ukraine" (Director Olga Rydna), which during the war took care of hundreds of families in Kharkiv and Kharkiv Region, makes a proposal to the mayor and city deputies to make urgent changes to one important social program that operates in Kharkiv.
The fact is that today the civilian wounded - people who have been injured or damaged as a result of mine-explosive damage during rocket, air and other shelling - need priority help. Unfortunately, the number of such wounded people in Kharkiv is increasing every day. But their treatment and subsequent rehabilitation falls financially on the shoulders of relatives or charitable organizations, which at the critical moment of saving lives can, at least partially, cover the costs of the most necessary, expensive drugs and means of rehabilitation. The fact is that civilian wounded can receive state compensation or benefits only after passing the MSEK (and children under 18 years old LKK) and receiving a disability group and a conclusion that it occurred as a result of mine and explosive injuries during the war in Ukraine. And before that, a person is alone with his problems, is under incredible stress and, in the vast majority of cases, is legally unaware of his rights as a result of an injury! Ukrainian legislation on this matter also needs changes and additions, but it is worth recalling which normative legal acts today are the basis for settling the issue of social guarantees and assistance to civilians wounded during the war. In particular, the law "On mine action in Ukraine", number 2642, approved by the Verkhovna Rada on December 6, 2018 with amendments and additions; Resolution of the CMU "Some issues of appointment and payment of one-time compensation and annual assistance provided for by the Law of Ukraine "On Mine Action in Ukraine", number 1020 of September 29, 2021. And also the Law of Ukraine "On the Status of War Veterans, Guarantees of Their Social Protection", number 3551, dated 10/22/1993, as amended. Article 10 of the law "On Mine Action in Ukraine" provides state guarantees for assistance to injured citizens, - provision of medical, psychological, professional and social assistance in order to reduce the consequences of injuries caused by explosive injuries.
Part 3 of Article 10 refers to a one-time compensation for damage to the health of an adult and a child under 18 years of age and annual assistance for recovery. Their sizes are set by the Cabinet. It is important to know that according to the legislation, compensations are awarded on the condition that an application is made no later than 60 calendar months after establishing the connection of disability with damage by explosive objects and the conclusion of the LKK for children and MSEK for adults. Expected payments: - for the 1st group of disability, 5 times the amount of the subsistence minimum for persons who have lost their ability to work, established on January 1 of the current year (now it is UAH 2,361 multiplied by 5, equal to UAH 11,805); - for the 2nd group - 4 times payment (9444 UAH); - for 3 groups - 3 times (7083 UAH).
Civilians who were injured as a result of mine-explosive injuries during the war can receive the status of a war veteran in the prescribed manner. As a result, they will be covered by social protection guarantees in accordance with the provisions of the Law of Ukraine "On the Status of War Veterans and Their Social Protection".
It provides for 36 items of benefits and assistance designed to make the life of a veteran easier - from free medication, dental prostheses, provision of other prostheses and means of rehabilitation to a 100 percent discount on utility services, priority home repairs, discounted fuel for home heating, free transportation, employment, emergency housing, car, etc.
In the same way, pensions (social benefits, life support) for persons with disabilities as a result of the war are increasing: - for 1 group, 50 percent of the subsistence minimum for persons who have lost their ability to work; - 2 groups - by 40 percent; - 3 groups - 30 percent. It is obvious that some benefits for veterans are outdated, stretched over time and need to be modernized, or their provision has been transferred by the state to local self-government bodies. But their expenses have a legal basis and they are provided over time. However, people who have just been injured and are undergoing treatment or rehabilitation are completely helpless - physically limited by their health, without financial benefits and guarantees, alone with a multitude of problems that have piled up on them.
That is why help is so important in this period. In this case, local self-government bodies can quickly react and connect their resources. In particular, the "Program for promoting safe life in the field of social protection of the population of the city of Kharkiv for 2021-2025" approved on August 19, 2020, is in effect in Kharkiv. In addition to granting benefits to war veterans, families of fallen soldiers, defenders of Ukraine, it should include assistance to those who find themselves in difficult life circumstances.
